DEFINITIONS:
Consumer:
- This is you, whether you buy goods or services;
- When goods or services are marketed to you;
- When you use goods or services;
- When you did not buy the goods or services, but received them
as a gift;
- When you did not buy the goods or services but used them in
your household when someone else bought them.
Goods
- Goods are everything that are marketed for human consumption;
- Goods include all tangible and intangible products and legal
interest in fixed property.
Intermediary:
- An intermediary is someone who represents another person by
marketing that other persons goods or services.
Person
- This includes a company, which could be a manufacturer, producer,
supplier and/or retailer.
Consideration
- Includes anything of value, given and accepted in exchange for
goods and services;
- Includes, for example, money, property, vouchers, credits, loyalty
credits etc.
The Act applies to the supply of goods or services by a person provided that:
- The goods or services are supplied within South Africa;
- The goods or services are supplied in the ordinary course of
business by the person;
- The goods or services are supplied to the consumer for consideration;
- The consumer is a juristic person (company) whose asset value
or annual turnover is
- Below the threshold value determined by the Minister from time
to time;
- "The specific goods or services have not been excluded from
the Act.
